1- INTRODUCTION
Welcome to WOW VIR. The following contract spells out what you can expect from us, and what we expect from you. THESE TERMS CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT APPLY TO YOUR PURCHASES. If you agree to what you read below, you should click "Yes" at the end of the contract to acknowledge that you have agreed to our Terms of Services and our privacy policy., and equally binding. Only by clicking “Yes” will you be able to access and use the services available on this Website.
2- ACCESS AND SERVICES
Your access to the various services available on this system depends on the level of access you select. You may change or discontinue your account at any time. We reserve the right to modify, suspend or terminate access to the service on our system at any time for any reason without notice or refund, including the right to require you to change your login identification code or password. Registration is free of charge. No entitlement exists for admission to the Service. The data required for registration provided by the User must be complete and accurate. The User is responsible for updating his/her own data that can be amended at any time from the respective interface of the Service.
3- ORDER PLACEMENT / CONTRACTUAL RELATIONSHIP
By placing an order through the application or the website, the User confirms the accuracy of all the information he/she provides. Orders are confirmed to the User within Service interface. The contractual relationship exists between User and the vendor and the User herby agrees that there is no sales agreement between ….. and the User and ……. only facilitates the sales agreement between the vendor and the User. …… may decide for any reason whatsoever to not accept an order and to refuse to perform it. User may schedule the order for a selected time, date, week or month as per availability of Service.
4- AMENDING AND CANCELLING ORDERS
Once the order has been confirmed, the User may be unable to make any amendments using the technical features provided by the Service.
5- INCOMPLETE ORDER FULFILLMENT / SUBSTITUTION
User acknowledges that the goods are subject to stock availability and to human errors…… reserves the right to amend your order in whole or in part, at any time and without liability or compensation remove any item that is out of stock, damaged, spoiled, or unavailable for any other reason, to successfully complete your order. If, however any product you order is out of stock or unavailable we may send you a push notification enabling you to select a substitute. If an item is not delivered, despite being billed, the amount in question will be credited to the User at a reasonable time after WOW VIR becomes aware of this. No subsequent delivery is obligatory to be made, and the User is not entitled to claim any further compensation. If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to the User. Please note that we will attempt to send the User push notification of substitute products in the event that selected products are unavailable, the User may reject these substitutes. Although we will always try to cater for your orders, an order of unusually large quantities of different or one product can only be fulfilled at the discretion of the WOW VIR.
6- DELIVERY TIMES AND ADHERENCE TO DELIVERY PERIODS
WOW VIR endeavors to deliver goods within 90-120 minutes’ average delivery time location dependent or as scheduled. WOW VIR does not and cannot guarantee that the delivery time frames will be met as there may be factors outside of control of WOW VIR that may result in early or delayed deliveries. You agree that WOW VIR shall not be liable for any deliveries made outside the expected delivery time frame.
7- DELIVERY RECEIPT
The shop holds the responsibility to provide the user with the receipt upon delivery.
8- CANCELLATION OF A DELIVERY
If, for reasons beyond the control of WOW VIR such as bad weather conditions, an incorrect delivery address, the recipient's absence, or any other situation beyond the control of WOW VIR
WOW VIR is entitled to cancel the User’s order. In this event, the User is not entitled to compensation or pecuniary of in kind, however; in case of online payment, the refund will be initiated by WOW VIR at the soonest possible post the cancellation of the order, it is the responsibility of the bank to transfer the amount to the users account, which takes approximately 3-5 working days.
9- FEES AND PAYMENT
WOW VIR endeavors to provide you with accurate and up-to-date pricing, product availability and promotional information. However, you agree not to hold WOW VIR liable if any discrepancies occurs due to any reason which is not in control of the WOW VIR
You will be given the opportunity to pay by credit card or by debit card for any services provided by us. You can cancel your account at any time, but you will remain liable for all charges accrued up to that time, We reserve the right to change our fees at any time for any reason, but, whenever possible, we will give you at least one month's advance notice of such change.
10- PRODUCT INFORMATION
WOW VIR endeavors to update the product information. However, information may deviate from the details printed on the product packaging. In such an instance, the information on the packaging takes precedence.
11- SYSTEM RULES
You agree to be bound by certain rules that are important for the proper use of this service. Your failure to follow these rules, whether listed below in the contract or in bulletins posted at various points in the system, may result in termination of your service. First, do not tell others your password or let your account be used by anyone except yourself. Second, do not attempt to log in more than once at the same time on any given account without specific permission of one of our operators.

13- PROPRIETARY RIGHTS
By posting messages, uploading files, inputting data, or engaging in any form of communication on our system, you are hereby granting to the public an unrestricted license to use, copy, modify, adapt or document in any form. You shall have absolutely no recourse against us as the system provider for any alleged or actual infringement of any proprietary rights to which you may claim ownership.
Your use of our system affords you access to many of the features of our system, but some aspects of our system remain within our exclusive proprietary control. We or our suppliers own the intellectual property rights to any and all protectable components of our system, including but not limited to the computer software, the related documentation, the end-user interfaces, the name of our system, many of the individual features, and the collective works consisting of sequences of all public messages on our system. You may not reproduce any sequence of messages from our system, either electronically or in print, without our permission. In addition; you may not copy, modify, adapt, reproduce, translate, distribute, reverse engineer, decompile or dissemble any aspect of the system that we or our suppliers own.
14- LIMITATION OF LIABILITY
You must bear the risk of any liability relating to your use of our system. We would not be able to afford to operate this system if we were held accountable for every wrongful action by every vendor or service provider registered with us. ACCORDINGLY, YOUR USE OF THE ONLINE SYSTEM IS ENTIRELY AT YOUR SOLE RISK. WE WILL NOT BE RESPONSIBLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT OR INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES YOU MAY INCUR IN CONNECTION WITH OUR SYSTEM, YOUR USE THEREOF OR ANY OF THE DATA OR OTHER MATERIALS TRANSMITTED THROUGH OR RESIDING ON OUR SYSTEM, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF WE HAVE ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS.
15- INDEMNITY
You shall defend and indemnify us and hold us harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys' fees), relating to any acts by you or materials or information transmitted by you in connection with our system, leading wholly or partially to claims against us or our system by other users or third parties, regardless of the type of claim or the nature of the cause of action.
16- DISCLAIMERS OF WARRANTY
THE SYSTEM IS PROVIDED "AS IS" AND WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE, NON-INFRINGEMENT OR ANY OTHER WARRANTY, CONDITION, GUARANTY, OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED THEREIN OR PROVIDED BY THE SERVICE PROVIDES.
17- CHOICE OF LAW
You agree that this Agreement shall for all purposes be governed by and construed in accordance with the laws of United Arab Emirates and that any action arising out of this Agreement shall be litigated and enforced under the laws of the United Arab Emirates. In addition, you agree to submit to the jurisdiction of and that any legal action pursued by you shall be within the exclusive jurisdiction of the courts of the United Arab Emirates.
18- ACKNOWLEDGMENT
This Agreement represents the entire understanding between you and us regarding your relationship to Online and supersedes any prior statements or representations. IF YOU AGREE TO BE BOUND BY THE TERMS OF THIS ONLINE SUBSCRIBER AGREEMENT, please click the "Yes" button below.
